I don't see a clearly labeled firmware version on the label of my drive, but it does say "DRIVE REV AAA AA00 / BB0". It most definitely responds to spin-down commands, I've had the OS configured to spin it down after 30 minutes of inactivity and this has worked fine. Personally I think the Toshiba hard drives are the poorest ever offered and don't be so sure that it really passed any tests because they have been known to pass failed drives.
