About this deal

The Criminal Justice and Court Services Bill [10] was led by the Home Office as most of the Bill’s provisions concerned the establishment of a National Probation Service for England and Wales. A few parts concerned Cafcass arrangements. [11]

Cafcass set up a meeting to explain what was going on and that helped. They told us why we were going through this process. It was useful to have them break down the situation and explain what was going on. I didn’t feel so scared after that. I told Anne that I liked playing with my dad, and I missed him. But it was better at home now there was no shouting and arguing. It was a few years ago and it was hard for me and my brother. The whole thing was scary because we didn’t know what was happening or what was going to happen. Me and my brother were really happy with the outcome. I live with my mum now, but I see my dad nearly every day. He doesn’t live far from me. My mum and dad are on speaking terms now as well, which is really good. At the first hearing the court will determine the future role of Cafcass in the proceedings. If there are no welfare concerns then a Cafcass officer may still be involved to try to assist the parties in coming to an agreement with minimal further court proceedings. If parents are unable to reach an agreement or there are welfare concerns then the Cafcass officer may be asked to carry out further work with the family and prepare a more detailed report on the welfare issues. Cafcass Report your estate has been sequestrated in Scotland or you enter into a debt arrangement programme under Part 1 of the Debt Arrangement and Attachment (Scotland) Act 2002 (asp 17) as the debtor or have, under Scots law, granted a trust deed for creditors. The Performance Committee which monitors national performance against KPIs and Cafcass’ impact on the whole family justice system key performance measures (KPMs). [20]

appoint a solicitor to represent the child in court and to instruct the solicitor (Occasionally the child and children’s guardian do not agree on what is in the child’s best interests and if the solicitor decides that the child is of sufficient age and understanding, the child may be able to instruct the solicitor if the court gives permission for this to happen.); Cafcass publishes an annual report of its activities together with its audited accounts after the end of each financial year. Cafcass provides to the Ministry of Justice its finalised (audited) accounts in line with HM Treasury guidelines. The Assessment and Child’s Plan is the section of the child’s record where FCAs and Guardians record their thinking, developing analysis and reasoning for the child. It is where the manager’s oversight is also recorded. You can take steps towards improving communication with your ex-partner with our free online Parenting Plan. The child’s FCA or Guardian will be open to new information as this emerges, including the information gained directly for the child and from those who know them well, such as members of the child’s wider family and other professionals involved with the child and family. They analyse and reflect on the impact of the child’s experiences to help them form a picture which about what the child needs to support their wellbeing and development.

drawing up a parental responsibility agreement with the mother, which is a specific form that must be signed by both parents, witnessed and registered with the court; Family Justice Review Final Report" (PDF). www.gov.uk. Four key areas are repeatedly identified as being key areas to focus on improving the quality of assessment, these are: engaging the child in person, information gathering, critical analysis, and inter-professional working. These four elements are supported by careful use of the practice aids and resources in CIAF. It was good to speak to the Cafcass worker because at that point it was really hard to talk to my parents, and really hard to communicate with both of them. Cafcass told us about the possible outcomes and what might happen, and that was helpful.I would say to any young person going through this, don’t be afraid to say how you’re feeling and don’t be afraid to ask questions if you don’t understand something. It’s better to ask there and then because you have to go through the whole process. There’s a big decision that’s going to be made at the end of the day and you have to know what’s going on so you can tell people how you feel.
